Gautreau jailed

Joshua Gautreau, 32, pleaded guilty in Sussex Provincial Court May 8 to possession of a stolen laptop.

The Moncton area man was sentenced to 30 days in jail for the March 11 offense.

Gautreau had taken the laptop to a local computer repair shop when a worker noticed almost immediately it was stolen. Police later found out it was the property of the University of New Brunswick in Saint John.

The hot computer was purchased by Gautreau for $125 and he admitted he had an idea it was stolen when he bought it. He did not provide police with the name of the person who sold it to him.

More jail time for thieves

Crystal Deveaux, 26, and John MacDonald, 37, were in Sussex Provincial Court May 8 each facing a charge of theft.

They have been serving jail sentences for a string of thefts in southern New Brunswick which included Sussex.

The couple was caught on surveillance video and pleaded guilty to stealing three portable DVD players and a $250 coffee machine Feb. 18 from the local Atlantic Superstore. MacDonald later tried to return the items as if he had purchased them.

Judge Henrik Tonning tacked 30 more days in jail to the respective sentences they are now serving.

"They're both old enough to know better," he said.

Probation for mischief

Matthew Cecil Kilpatrick, 20, pleaded guilty in Sussex Provincial Court to a pair of charges stemming from a June 25 incident.

Kilpatrick, of Kierstead Mountain, was given a two month conditional sentence and probation for mischief damage to the group home he was living in at the time, which was also a breach of the probation he was serving.

Kilpatrick must obey a daily curfew of 7 p.m. to 7 a.m. during the next two months, unless given permission by a probation officer to be out.

Kierstead assaulted wife

Stephen Kenneth Kierstead, 53, was given a three-month conditional sentence for assaulting his common-law wife.

The couple's young children called 911 to report the incident to police and told the operator their father was hitting their mother.

The woman was struck in the face after the two came home from a Christmas party where the Wards Creek man had become agitated.

"I feel very sorry about it," Kierstead told the court as he apologized to the court and his wife, who was there with him.

Following his three-month sentence, Kierstead will be on probation for 18 months during which time he must keep the peace toward his wife and take any courses or counselling as directed by his probation officer.

Fitzpatrick guilty of DWI

Joseph Wayne Fitzpatrick, 51, was found guilty of driving while impaired in Sussex Provincial Court May 9.

The Miramichi area man was found by police in Sussex Nov. 12 after a reckless driving complaint.

After he failed a roadside test, he was brought to the local detachment for a Breathalyzer test, where his readings were more than twice the legal limit.

Judge Henrik Tonning fined him $1,035. Fitzpatrick is also banned from driving in Canada for one year.

Hodd jailed

Stephen Joseph Hodd, 56, pleaded guilty in Sussex Provincial Court to driving while suspended.

The Roachville man was given a 30-day sentence, to be served on weekends, for the June 2 incident in Sussex. Hodd was stopped after he was seen driving through a stop sign at 2 a.m.

Sentenced for breaking court order

At a May 5 bail hearing in Hampton Provincial Court, Raymond Joseph Cyr of Rothesay pleaded guilty to breaching a court order and received a six-month suspended sentence with several conditions.

Cyr, 18, was charged May 2 in Quispamsis with failing to abide by a court undertaking issued April 18 to report in person to the Rothesay Regional Police office by noon each Friday.

He pleaded guilty and Judge Anne Jeffries issued a six-month suspended sentence.

Cyr is to obey a 9 p.m. to 7 a.m. curfew in his residence, notify police of any change of address and allow police entry without a warrant into his residence to check compliance. He is not to consume drugs or alcohol, and he is to have no contact with four female persons named by the court.

"No contact means no texting, no phoning, no getting a friend to [relay messages]," said Judge Anne Jeffries.

Entering treatment program

Rodney Lee Sprague, 49, of Midland opted to plead guilty to two impaired driving charges when he appeared in Hampton Provincial Court May 5 for his scheduled trial.

He was charged Oct. 20 in Hampton and April 25 in Bloomfield.

Defence counsel David Lutz said Sprague was entering a 28-day curative treatment program at Ridgewood Addiction Centre.

Sprague was released by Judge Anne Jeffries to return to court for sentencing Aug. 26. In the meantime, he is under court orders not to drive and not to consume alcohol and non-prescribed drugs.

Sentencing dates set over

Ryan Joseph Woodland's sentencing, originally set for May 6, has been set over for three weeks because Judge Henrik Tonning was away.

Woodland, 27, of Rothesay pleaded guilty April 1 to assaulting a man in Rothesay Feb. 21 and to possession of an illegal weapon, a butterfly knife.

Judge Alfred Brien set Woodland's sentencing date for May 27. He set the same sentencing date for Robert James Drew-Schafer, whose sentencing for a break and enter had to be set over.

Brien set a new sentencing date of June 10 for Daniel Joseph Chevarie. The 43-year-old Baines Corner man will be sentenced on a theft charge.
